A new class action lawsuit claims Fashion Nova misled shoppers with fake discounts and inflated prices on its website.
Five consumers have filed a class action lawsuit against Fashion Nova LLC, alleging the retailer uses misleading sales tactics to entice customers into making purchases. The suit, filed April 2 in Washington federal court, claims Fashion Nova violates state and federal consumer protection laws by creating the illusion of limited-time offers and significant discounts.
Claims of Deceptive Sales Practices
According to the complaint, Fashion Nova’s website frequently displays countdown timers, strikethrough “regular” prices, and large discount percentages. However, the plaintiffs allege these sales are not genuine. For example, the “Weekend Sherpa Denim Jacket” was advertised with a regular price of $69.99 but was always sold at a discount—sometimes for $48.99, other times for $28.98.
“While there is nothing wrong with a legitimate sale, a fake one—that is, one with made-up regular prices, made-up discounts, and made-up expirations—is deceptive and illegal,”
— Fashion Nova class action said.
Allegations of Ongoing Deceptive Conduct
The lawsuit further alleges that Fashion Nova is aware of its deceptive advertising practices. It references previous Federal Trade Commission (FTC) investigations, which found the company had blocked negative reviews and failed to ship items in a timely manner. In May 2023, Fashion Nova agreed to a $4.2 million settlement with the FTC to refund affected customers, but the plaintiffs claim the misleading practices have continued.
Class Action Details
The suit seeks to represent consumers nationwide who purchased Fashion Nova products advertised at a discount before March 29, 2024. The plaintiffs are suing for violations of advertising, consumer, and competition laws in California and Oregon, as well as breach of contract, breach of warranty, and unjust enrichment. They are seeking class certification, damages, and an injunction to stop Fashion Nova’s alleged deceptive conduct.
