Birkenstock Wins Dutch Injunction Against Lidl Sandal Lookalikes

Birkenstock says the injunction carries a €5,000 daily penalty for noncompliance. The company also says the court ordered Lidl to account for relevant sales and orders, with damages and legal costs to be determined separately. The decision matters to footwear retailers because the dispute is over recognizable product design, not only a word mark or logo. A retailer carrying close visual substitutes in the Dutch market could face a different risk assessment if the decision stands. It does not, by itself, establish a Europe-wide ban on similar sandals.
